Will My Case Settle Or Go To Trial?

|

Whether a case settles or goes to trial shapes almost every decision you’ll face after an injury. It’s reasonable to want a clear answer on who actually makes that call—and why an insurer might choose one path over the other.

Will My Case Settle Or Go To Trial?

That decision belongs to the insurance company’s adjuster, not to us. The adjuster weighs the risk of paying a potentially large trial verdict against the certainty of resolving the claim through a negotiated settlement. We can build the strongest possible case and apply pressure, but we can’t dictate how the insurer responds.

A risk-averse insurer will often prefer to settle rather than face a jury. The concern isn’t only the immediate cost of an adverse verdict—it’s also the precedent that verdict could set in future claims.
